| TERMS AND CONDITIONS |
The following is the agreement between the parties relating to the use of the Margate Bridge Quick Toll Card, ("QTC"). The
words "we", "us", "our" means the Margate Bridge Company,("AUTHORITY"). The Margate Bridge Company is a private
company and holds no affiliation with the City of Margate, NJ.
Definitions. (a) "PREPAID TOLL" shall mean the initial payment and subsequent payments to replenish your account, for the deduction of applicable tolls and fees.(b) "TRIP(S)" shall mean a fare incurred for a single one-way passage across the bridge. (c) "ACCOUNT" shall mean the QTC Account established with the AUTHORITY by this agreement to be maintained for the purpose of deducting tolls and fees. (d) “ANONYMOUS” shall mean an ACCOUNT for which no identifiable information is stored.
1. License. Subject to the terms of this Agreement, the AUTHORITY agrees to license the QTC to you for passage through the Toll Lanes.
2. Use of QTC. You agree:
a. ONLY TO USE THE QTC IN CONNECTION WITH THE OPERATION OF A CLASS 1 VEHICLE (Passenger car, light pickup truck or SUV with a Gross Vehicle weight of 5,999 lbs. or less) A trailer used in conjunction with a Class 1 vehicle will be charged an additional TRIP.
b. To use the QTC in the proper method, in accordance with AUTHORITY guidelines to assure proper reading of the QTC. If improper usage results in the failure to register passage through a toll lane, you may be subject to administrative fees incurred in addition to toll violation prosecution.
c. Agree to pay the cash fare until your QTC has been activated. You are responsible for any Toll Violations that occur prior to the opening of your ACCOUNT and your receipt of the QTC or on an ACCOUNT without sufficient TRIPS remaining. You understand that a new ACCOUNT may take up to 10 business days to become active and for you to receive your QTC.
d. Not to proceed through any Toll Lane unless the signal light located at the Toll Lane is green. If you do not receive a green light, you must pay the applicable toll in cash in order to proceed through the Toll Lane, or ask for assistance You understand that failure to do so may subject you to forfeiture of your QTC and applicable fines.
e. THAT AS YOU APPROACH A TOLL LANE, YOU MUST COME TO A COMPLETE STOP.
f. To comply with all applicable traffic laws, as well as rules of the AUTHORITY, and to surrender your QTC immediately upon request for any violation of the terms of this Agreement.
3. ACCOUNT. The AUTHORITY will maintain contact information and driver’s license for your ACCOUNT. Contact information will be used to verify an authorized ACCOUNT holder.
4. ANONYMOUS. Should you elect to maintain an ANONYMOUS ACCOUNT, you agree that: a) You must replenish your ACCOUNT in person. b) You forfeit any TRIPS remaining on a QTC which is replaced for any reason or when an ACCOUNT is terminated. c) You forfeit any right

of notification to changes in the terms and conditions.
5. PREPAID TOLL. You agree to establish or replenish your ACCOUNT in standard increments according to the AUTHORITY Fare Schedule. Your ACCOUNT will be credited with an amount of TRIPS appropriate for the replenishment level. ACCOUNTS may be replenished via the website (www.margatebridge.com) or in person at an authorized AUTHORITY location. You understand that replenishment on your ACCOUNT may take up to 5 business days.
6. Fees.
a. You will pay to us the appropriate PREPAID TOLL when you submit your application and/or replenish your ACCOUNT. The PREPAID TOLL Increment shall be as follows:
A single TRIP will be deducted from your ACCOUNT each time a QTC is used to gain access or exit through a toll collection area. A second TRIP will be charged for use of a trailer in conjunction with your vehicle.
b. Fare Schedule Fare schedule is subject to change without notice at the discretion of the Margate Bridge Company.
c. Deposit. There is a $5.00 deposit charge for each QTC issued on an account. This charge will not be applied again when the ACCOUNT is replenished. Deposit will be refunded when your QTC is surrendered in full working order and your account is otherwise in good standing.
d. Lost, Stolen, Defaced or Abused QTC. If the QTC is lost or stolen, notify us immediately. Until you notify us that the QTC has been lost or stolen, we may continue to deduct from your ACCOUNT any TRIPS incurred through use of the QTC. Once you notify us that the QTC has been lost or stolen, we will deactivate the QTC so it can no longer be used and we will issue you a new QTC. If your QTC is damaged due to defacement, abuse or improper use, we will replace it with a functioning QTC. You will forfeit your deposit for a QTC card which must be replaced. An additional deposit must be made to receive your replacement QTC. Any remaining TRIPS will be transferred to the replacement QTC.
7. Violation of Terms and Conditions. Failure to abide by any of the terms and conditions of this agreement may result in the termination of this agreement. The AUTHORITY reserves the right to terminate this ACCOUNT and deactivate the QTC(S) issued under this agreement for failure to abide by any of the terms and conditions of this agreement. Any TRIPS made through a Toll Lane with a deactivated QTC or without paying the proper toll may result in an administrative fee of $25.00 per TRIP. The AUTHORITY reserves the right to report delinquent ACCOUNTS to an authorized credit bureau. AUTHORITY reserves the right to prosecute violators in the Margate Municipal Court for violation of N.J.S.A.39:4-120.10 which

6. Fees.

b. Fare Schedule Fare schedule is subject to change without notice at the discretion of the Margate Bridge Company.
c. Deposit. There is a $5.00 deposit charge for each QTC issued on an account. This charge will not be applied again when the ACCOUNT is replenished. Deposit will be refunded when your QTC is surrendered in full working order and your account is otherwise in good standing.
d. Lost, Stolen, Defaced or Abused QTC. If the QTC is lost or stolen, notify us immediately. Until you notify us that the QTC has been lost or stolen, we may continue to deduct from your ACCOUNT any TRIPS incurred through use of the QTC. Once you notify us that the QTC has been lost or stolen, we will deactivate the QTC so it can no longer be used and we will issue you a new QTC. If your QTC is damaged due to defacement, abuse or improper use, we will replace it with a functioning QTC. You will forfeit your deposit for a QTC card which must be replaced. An additional deposit must be made to receive your replacement QTC. Any remaining TRIPS will be transferred to the replacement QTC.
7. Violation of Terms and Conditions. Failure to abide by any of the terms and conditions of this agreement may result in the termination of this agreement. The AUTHORITY reserves the right to terminate this ACCOUNT and deactivate the QTC(S) issued under this agreement for failure to abide by any of the terms and conditions of this agreement. Any TRIPS made through a Toll Lane with a deactivated QTC or without paying the proper toll may result in an administrative fee of $25.00 per TRIP. The AUTHORITY reserves the right to report delinquent ACCOUNTS to an authorized credit bureau. AUTHORITY reserves the right to prosecute violators in the Margate Municipal Court for violation of N.J.S.A.39:4-120.10 which
provides for fines as much as $200.
8. Termination of License: We may terminate your license to use the QTC at any time. You may terminate your license to use the QTC at any time by returning the QTC to us either in person or via certified mail. No cash refunds will be made under any circumstances. The QTC will remain our property under all circumstances and will be returned to us by you if we so request. Failure to return a QTC to the AUTHORITY in good condition either in person or by mail to the QTC Center upon termination of your license or upon request by the AUTHORITY will result in forfeit of your deposit and remaining TRIPS on the ACCOUNT.
9. Defective QTC. If the QTC is defective for reasons other than abuse or improper use, and such QTC is returned to us, we will replace it at no charge to you and transfer any remaining TRIPS to the new card. You acknowledge that we have not made, and we expressly disclaim, any representation or warranty, expressed or implied, relating to the QTC (including without limitation, any implied or expressed warranty of merchantability, fitness for a particular purpose or conformity to models or samples).
10. Miscellaneous.
a. You agree that the AUTHORITY has no obligation or liability to you with respect to your use or the performance of the QTC. You agree to indemnify and hold harmless the AUTHORITY from and against any and all damages, loss, cost, expense or liability relating to, arising from, or as a result of the use or performance of the QTC.
b. The Margate Bridge Company reserves the right to change, update and /or alter these terms at any time.
c. You agree to pay all costs, including attorney's fees, incurred by us to enforce the terms of this Agreement.
d. This Agreement shall be binding upon and inure to the benefit of you and your successors and the AUTHORITY and its successors and assigns. You are not permitted to assign the obligations or benefits of this Agreement.
e. This Agreement shall be deemed to have been executed in Margate City, New Jersey, and all questions of interpretation shall be governed by, and construed in accordance with the laws of the State of New Jersey, venue of all matters shall be with the Atlantic County Superior Court.
f. The invalidity of any term or terms of this Agreement shall not affect any other term of this Agreement, which shall remain in full force and effect.
g. YOU WILL INFORM THE AUTHORITY WITHIN 30 DAYS OF ANY CHANGES TO THE INFORMATION SET FORTH ON THE QTC APPLICATION BY PROVIDING WRITTEN NOTICE TO:
